State Specific Question About: NEW YORK (NY)
My tenant's lease expired June 30th and they asked to go to a month to month becuase they may be breaking up, which I declined. I sent them a letter by regular and certified mail stating that I would give them one month until July 31st to make a decision. I stated that if I do not have a signed lease by July 31st they must vacate. If they don't sign a new lease what are the steps to evict them. They have been good tenants that pay on time but I don't want to get stuck trying to rent the apartment around the holidays or in the winter when it is nearly impossible to do in the New York area. I've never had a tenant stay over when they declined to sign a new lease and we were showing the apartment (starting minimum 30 days from their lease end!) YOu have waited too long to show!! --173.16.xx.xxx |

Since you agreed to give them 1 month until July 31, how did you settle that? With a 1 month lease, or by letting the previous lease lapse into a month-to-month tenancy?
If they have a lease until July 31, then they are obligated to leave then without notice. If they are now month-to-month tenants, then you will have to terminate their tenancy, which probably involves at least 30 days notice. Since there are no longer 30 days remaining until July 31, you will not be able to get them to leave by then without further negotiation.
