State Specific Question About: MASSACHUSETTS (MA)

I love this website. I learn every time I visit, and all of my fellow LL's have been extremely supportive during this most difficult time. Thank you again! As some of you know, I am going through the 14 Day Notice (15, or 16 depending on which day you call NEHC! AARGH!)

So I just found this "72 Hour Warning Notice to Report Unfavorable Information to Credit & Tenant Reporting Agency" form. I was thinking of dropping it off on the way to the constable next week, to see if my tenant would rather choose to leave voluntarily. Any thoughts, reservations, or warnings before I do this? Can I really go ahead and report the rent in arrears to the credit agencies, and the other problems to the tenant check agency during this process? --205.188.xxx.xxx

IMO it would be a waste of your time to do a 72 hour notice. Continue with the 14 day notice followed by the court summons. One of the constables that I use is very successful at convincing tenants that it is in their best interest to leave quickly & without causing further damage. I have no idea what he tells them but it seems to work & saves me the cost of paying for a move out & the required storage.

Have you considered offering them cash for keys? Some LLs will never do cash for keys while other LLs realize that sometimes it is a prudent business decision to spend a few dollars to regain control of their unit faster than going thru the court system. --72.85.xxx.xxx

STEVE!! Thank you - you have given me the best advice so far. Is your constable near Lowell? I will need one next week. :)

Yes - I made an offer to give her cash for keys verbally, to which she did not respond. Her only consent was to admit that she has been lying to me all along, when I stated I had always kept my word, and would stand by my offer. My offer expires at the end of this month, but w/the way she lies, I have to go on w/the evict. process.

Tammy, my constable does not go to your area.

I have a case scheduled for July 5, 2011 at 9:00 AM in the Lynn session of the NEHC. Presuming that she hasn't filed for discovery of a postponement.

To find a constable in your area I would ask for a recommendation from someone in the Lowell area LL group. --72.85.xxx.xxx

remember summons and complaint have to be seerved by court officer in mass.constable or sheriff. i would offer to get tennie 2 guys and a small truck and move them.maybe toss 200 at them.no eviction on their record.sometimes it works. --173.162.xxx.xxx
