I read on MA.gov that a landlord can file a small claim for rent payments that are less than $2,000.00. Can this be done while pursuing an eviction? --64.12.xxx.xxx |

i would get the eviction first and after they are gone go after the rent.its nice to have a favorable judgment in hand when u go into court for money.if u are given a judgment for the money u dont have to go for another judgment.i would offer to accept 50 monthly for the judgment if they dont pay it in one shot which they wont i expect. --173.162.xxx.xxx |

Thx Billy. The reason I ask is that it said you can file one for each continuing month. So if this takes to mid-Aug, then I could file one now, one in July, etc. A full blown civil suit is expensive, and I would rather not have to hire the atty. --64.12.xxx.xx |

I concur with Dan [MA] why bother filing additional actions. When you prevail with your non-payment eviction case you should be awarded 14 day notice expenses, summons expenses, filing fees & any unpaid rent up to the date they return the unit. I would definitely use their SD for any tenant damages. Then I would either use any remaining SD towards the court judgement or consider going to small claims for any damages not covered by their SD. --72.85.xxx.xx |

That's great news! I thought I would just win the right to forceful eviction, I didn't think they awarded damages too. Something that actually makes sense? In court???! I am waiting for my carpenter to call me back w/an estimate to fix the door her boyfriend kicked in the other night. I can't wait for this nightmare to end!! I am doing just this now, so will be interesting to see how it goes. Once you get your judgement for non payment from the housing court, you can take that to the small clams( district ) court. Tammy, you will not be awarded damages for things like the door being kicked in however you will be awarded back rent, summons fees, filing fees, etc.
Since this appears to be your 1st time going to court with a tenant I strongly suggest trying to attend a session prior to your court date. This will give you an opportunity to see how the court functions. --72.85.xxx.xx |

The difference between a housing court judgment and district court is that housing court only shows up on Tenant Network , not on their credit report. The reporting agencies only collect information from the district court not housing. And if the sec dep doesn't cover lost rent, you have to go to distinct court to get a judgment. --74.104.xxx.xx |

I filed a police complaint for destruction of property against the person who kicked it in. I had it repaired so that it functions, and got an estimate on a full replacement. When I pick up my copy of the complaint (as a listed victim) I will provide the receipt and estimate as proof of damages, and the criminal court should award me restitution. --64.12.xxx.xx |
