my tenant gave me a two week notice she will be out by july1st she signed a m2m agreement when she first moved in stating that she needs to give a 30 day notice -is there a penalty and does she forfeit her security deposit- thanks-dee --64.136.xx.xxx |

Tell her to put it in writing for your file and get a forwarding address.After she moves send her an accounting of her security deposit which you will keep for not giving sufficient notice along with what she owes for damages.Then when she does not pay you take her to small claims court and use the her letter as proof of when she gave notice --67.252.xx.xx |

Unless NY law provides for a forfeiture, the answer is no, she does not forfeit the security deposit. You will still have to account for (and refund, as approrpiate) the SD.
Question: Under NY law and your lease, can T give her 30 day notice on June 15 effective July 15? In some states/leases, the notice period has to coincide with the rental period, so that for most of us, the T's notice has to be for the last day of the month.
This is important, because it determines how much rent the tenant owes you. If she gave 2 week notice on the 15th and owes you 30 days notice, that is 16 days short (to the 15th of the next month), or is it 45 days short (to the 31st of the next month)?

My MTM rental agreement automatically renews the 1st of each month unless the tenant or myself gives the other a written 30 day notice. Therefore on the 1st of July they will owe you a month's rent. If they leave before then I would deduct the amount of rent owed from the SD along with any other damages or fees owed by them and give them a proper accounting . If they owed much more that the SD would cover I'd bill them for it and possibly sue in SC Court as I have done in the past. Here the courts have never had a problem with that.
