State Specific Question About: NEW JERSEY (NJ)
next door neighbor had a fire staurday, my 3 family house is 8 feet away (drive way) it melted my side siding.
now neighbor's insurance adjuster is saying it is tenant's fault by overloaded the electric outlet (the extention cord that have 4-5 outlets on it). my neighbor's liability will not cover my damage, it will be covered by my own insurance. adn they are trying to go after the tenant. (of course he ahs nothing)
is that sound right?
basically whta he saying is, it is not my neighbor's fault and my damage is caused by the tenant.

I'm not a lawyer, but I would name both the LL and the tenant in a court case for damages. Tenant for causing the fire due to overloaded circuts, and the LL for not doing safety inspections of their rental. --96.239.xxx.xxx |

I call this the blame game, they will blame whoever they can to avoid getting left holding the bag. How much is your damage? If it's really big, you might want to hire a public adjuster to fight for you.

damage is about 6k -8k.
tenant has nothing, my neighbor does not care about my damage (NOT HIS FAULT).
HOW do you sue LL who have tenant using power cord outlets ( Kmart , walmart $5)?
i did contact a public adjuster, but he is not too smart, all he care is about his 15% from my policy.
this whole thing just does not make sense to me, money is not the issue here ( either pay by my insurance co or neighbor's). it is the liability coverage of the insurance policy. the policy holder did no fault. his tenant did, and we do not cover that.

What did the fire inspector say?
If you turn it over to your insurance, they can fight it out with the other insurance company.
I agree, doesn't make much sense. Please, others chime in on this.

Even if the tenant is not now collectible, you want to get one more strike on their record so that other astute LLs will not rent to them...once in a while, they want to clean up their record, and may ask for a settlement and pay you something. --96.239.xxx.xxx |

this is even more interesting, fire dept claimed that it is confidential, cna only release info to my neighbor.i have a big augument with them this morning, I am the victim and not entitled to know the cause of the fire in writting. but the firemen on site that day verbally said it was the power cord overloaded the circuit, even the tenant admitted so too.

Why didn't the neighbor have a proper electrical service with appropriately sized breakers? Regardless of what the tenant plugged into the sockets, the breakers should have tripped before a fire started. That's why people name everybody and everything in a suit and then you see what's left when the judge/ jury makes their decision. Jerry [VA] is totally right, but the house was built 1940s, things were grandfathered, you can not force entire neighborhood to rebuild. he (my neighbor ) has CO too.
but again here is the point, one's neighbor has a fire in his house and the surrounding houses may be somewhat damaged ( siding ...)
the house is old, electrical may not up to date. tenant overload the circuit.
then you are not covered by your neighbor's
insurance policy. you need to turn to your own policy for damages ( you deductable, rate increase... that is your busines) not the house causing all this.

Jerry [VA] is not right. This depends on the situation. Example: a standard 15 amp circuit that will protect all of the wiring in the walls and the outlet. tenant puts a bunch of cheap extension cords in with everything plugged into it. The fire starts in the cheap extension cord. This is not a problem with house wiring it is the tenant's fault. This determination needs to be made by the fire marshal or similar. If it is the tenant's fault. Your house was damaged by the tenant. The fact that he has nothing is irrelevant.

As others have said, you should do this through your insurance. Ask them to subrogate the claim through your neighbors insurance and it will get taken care of. You will not have a claim show up that will affect your premiums. --216.139.xxx.xxx |
