State Specific Question About: OHIO (OH)

Regarding a month to month lease - tenant did not give me a written 30 day notice as stated in the lease agreement.

I haven't been able to rent apt. with much advertising.

Can I withhold the security deposit and prorate it according to the date when I will be able to rent it? --205.188.xxx.xxx

As required by law, you must give an accounting of the security deposit within 30 days of move out. Failure to do so could result in a judge awarding double the deposit to the tenant. If your rental agreement stated that 30 day notice must be given in order to receive a refund of the deposit, then you can go ahead and keep it, but you must still give a written accounting to the tenant. --66.61.xxx.xxx

You need to give us some dates here -- when did they move out exactly? What was the last month they paid for? I'm just taking a guess, but I'm actually thinking that you're already beyond the 30 days since they moved, yes? Did you do a proper accounting already?

You may already be in violation of the law on this. But, again, I'm making some assumptions -- so fill us in on the details if you want better advice.
