State Specific Question About: INDIANA (IN)
Hi, we have a small apt building with 3 apts. One of the features of our building is a back patio. However, the apt building next door which also has a back patio, also has some tenants who constantly throw their beer bottls away in our downspout drainage are, break their beer bottles on our patio and let their kids (very young) ride their little bikes on our patio. We have talked to the neighbors multiple times about this. We have put a lot of $$ into our building and now have good quality tenants. However, our tenants have complained about the neighbors. We are concerned that our tenants will move out or that new tenants will not want to rent because they feel uncomfortable etc. There is not a fence between the 2 closely proximated patios. We hate to spend the money on one but also don't want our tenants to have problems or concerns due to the bad neighbors. What would you recommend? --99.153.xx.xxx |

A fence sounds good, on the property line.
A lot of farmers around here split the cost 50/50 for proerty line fencing, but I am not for sure about a neighbor that is not as friendly.

I always liked the direct method, speaking directly to the neighbors. I ask nicely and thank them in advace. If that doesn't work, then if the neighbors are renters, I'd speak with the owners/managers. I document these coversations by writing a short summery and sending a copy to the neighbor and owner/manager -- and keeping a copy for my file with a proof of mailing. If still that doesn't work I have two more steps. 1) Contact the local police and ask for the neighborhood public relations officer to speak with them. 2) Finding out where the neighbors work, show up at their job and have a priviate converstation that if their conduct doesn't stop, then the police will pay them a visit at their job and it will have a negative effect on their employment.
When this happened to me with one of my 5 unit buildings, the neighbors thought they were hot stuff and nothing could touch them because the owner/managers of that property didn't care. After collecting pictures and writing letters I finally showed up at their work. Not not one of the neighbors but the husbands work, whe wife's work and a third adult who lived in the unit. Because I had filed a police report, I explained any damage done to my property would be considered done by them as retaliation. They were so affraid of their boss finding out they smoke pot, drink beer and party all weekend, they stopped causing problems -- problem solved. --173.55.xxx.xxx |

Good fences make for good neighbors. Relative to losing good tenants, this seems like a good investment. I would probably try Robert's advice first. Well, I wouldn't show up at someone's work but I would try talking w/them directly, letting neighboring property owner know, alerting cops, etc. If all that fails...build the fence.
Another crazy idea - install a fake video camera pointed at that part of the yard...maybe even a little sign that says "These premises under surveillance." --173.30.xxx.xx |

The way you deal with this is you contact the owner of the property, after calling the police, and inform the LL that if the conditions persisted you were going to sue HIM for damages.
I recently had to do this with a slumlord of a property adjoining mine. It took several months but we got the errant tenants out, and things are quiet once again. --166.128.xxx.xxx |

I'd contact the owner of the property, call the police, and put up a fence. Even just a couple of the pre-made panels of 6-ft fencing should help. Just enough to be sure they kow where the line is. Then the next time there is a problem, back to the police. --67.43.xxx.xxx |
