State Specific Question About: ILLINOIS (IL)

I rent to my girlfriend and her daughter has damaged the house by putting holes in all the doors, stoled her mother car and drove it thru the garage wall while drunk. Flushed a large object down the toliet to where it had to be replace, etc. She has been to court many of times and the state will not do anything except slap her on the wrist. So I told her mother once she turned 18 she has to leave. Can I evict her daughter only or do I have to evict them both? --65.211.xxx.xx

I am only guessing because I have not seen this situation, and I don't know IL law.

But if you evict the daughter, and Mom invites her to visit, wouldn't daughter be able to come to the house as a guest?

Unless you get some kind of "keep away" restraining order, I don't think evicting the daughter will be of any use.

The big thing is to get her out. Her mother doesn't want her there anymore, she loves her very much but cannot handle her. The mother is mentally abused by this kid and the courts are not helping. Since she is not 18 her mother is a prisoner in her own home. Once she turns 18 year old she is not going to want to leave since it is a free ride. --65.211.xxx.xx

Mom, wants her gone and I want her daughter gone. Mother is a great tenant, when she got her kid from her X all hell broke loose. I couldn't evict because she was my girlfriend but now that she turns 18 it is a different story. Mother is willing to leave if I have to evict both but I hope I just have to evict the daughter. --65.211.xxx.xx

Have mom start eviction when kid is 17 and 10 months, this way when she is 18 you dont have to start the process. also call the local homeless shelter and start the process for her so she knows you are serious. crazy but sometime the kid has to leave. as soon as you get the order , change all locks and then bar the windows,,, seek counsouling --99.20.xx.xxx

Unfortunately, I would ask the mom to leave now. Preserve your property and keep the daughter away from your place for good. It is lkely the daughter will only come over all the time or intimidate the mother even after she is evicted. Help the mother move now.....Then you both can help deal with the daughter later,but your property will not be in the crossfire. Sorry for your bad situation. I agree with Adele. Thousands in damages is being done to your unit. How do you collect?

Get them out even if you have to give mom a security deposit. It will be cheaper than the daughters next temper tantrum.

The mother can not handle her tells me it is several years too late for counseling, I have never heard of a -partial eviction-, it is all or none because of the guest policy afforded to anyone - if the guest does not leave then action must be taken but family is another matter entirely, I think it would be costly to watch someone destroy what you have worked hard to have. --99.128.xx.xxx

Hello, So heres the situation. Im 20 I have 2 sisters one is 24 and the other 22. The 24 year old is OUT OF CONTROL. Steals mine and my sisters belongings, destroys our property, is constantly under the influance, disrupts the house All hours of the night and has a Really bad attitude. The house is total chaos and hell. My mom told her to get out but my dad said no. SO my mom said she was goin to evict her. ---1)How long does that process take? 2)And can she set a timeline for how long she has to take her belongings and leave? --174.252.xx.xx
