tate Specific Question About: PENNSYLVANIA (PA)

/After my mother purchased all of her properties, in the year of 1979, for example, she put her name as trust with some of my siblings on one of the properties. She passed in Sept 2010. She wrote a will in July 2010, stating that all of her properties and assets were to be distributed equally among her 5 children. One of the properties has My mother's name, the word,trust, with 2 of my brother's names. One of my brothers died.

So now the one brother thinks he owns this property, by himself.

Does the will supercede this? --64.134.xx.xx

I am an attorney and former probate clerk in Phila. Wills (and probate in general) cover only probatable assets. A property held in trust on the deed is not a probatable asset and will go to the person or persons that it is in trust for. This is assuming the trust deed was done correctly. As far as the brother that died, is part of the trust property could go into his estate or could flip over to the other trust brother recipient, it depends on the wording of the deed. --69.98.xx.xxx
