I am scheduled for small claims court where I am trying to recover rent and damages from a previous tenant that was in the unit for 6 years and I evicted. The eviction is done. So now I am suing for back rent and damages for almost $3,000. I submitted good documentation. I have not been to small claims court in years.

What should I expect?

When you mention good records, this means the last 2-3 rent payment stubs or copies of checks - any tenant written complaints of sewer back-up, any surprises they will bring documentation on to -pull the knees- out of your case? I will be facing one soon where they took movies of the walk-thru and I mentioned how disappointed I was when I learned they had removed the smoke detector batteries, plugged the toilet but were able to run 600bux of water thru the other drains and nothing seemed wrong when the city housing inspector came recently to give the house a passing grade, I purposely went to each screen outdoors and after circling the house I asked her how there could be a tree in the sewer when there are no trees at this house or the ones on each side - I thought trees would have leaves, this is when she turned off the camera and got in her car with her witnesses and left - disgusted! I promptly switched the locks and have 2 times the security deposit for unauthorized painting inside, I have not yet figured out how to get the aquarium dropping out of the toilet drain - all the others drain fine. --76.241.xxx.xxx

Such vand*ls need to be found guilty and then be flogg*d and brand*d as a service and warning to society. It's premeditated, not some knee jerk reaction to a surprise rent bill to pay that month.

I know a judge who ignores the documentation and arbitrarily rejects $ 2,000 of a LL's claim. even when the tenant is a no show. Good luck and be prepared to be disappointed! --125.25.xx.xxx

so glad that key turn in inspections are not mandated in my state. just another waste of time. I would like to be able to prosecute for vandalism for tenants who leave the property such a mess.In my state to get to SC is a huge hassel --99.20.xx.xxx

Dan, Are you the guy I met at OREIA a few years back with the son at the dinner who is now an Eagle Scout?

Court: Ask local assoc members and go visit court to observe. Much of it depends on the local judge.

Charge full full price so when the judge knocks off some, you still get the total you need.

Pray they have a job.

Best advice: settle outside of court and present a signed document showing their agreement and garnishment amount. Our court has a special form for that.
