State Specific Question About: OHIO (OH)

I will be putting my occupied section 8 rental up for sale this week due to financial hardships along with a balloon loan that will be due in a couple of months. I plan to tell the renter personally and to send her a copy of the letter I am preparing for SMHA that will advise them of situation. Is it necessary to certify the letter to SMHA? I already know it will be a waste of $ to certify a copy to the renter so I am not going that route with her. I do intend to let all parties know that my agent and I have already discussed aiming for investors. What do you think? Thanks. --75.185.xxx.xx

I don't see why you'd need to send it certified. I'd just call the HA and mail it to them too. Regardless of how things shake out, there's tenant rights that will protect the tenant when a home is sold / foreclosed, etc.

Have you attempted to renegotiate the balloon note with the lender?

Thank you. I have spoken to the lender and it was not an option. However, they agreed verbally to do a short sale. Hopefully I will not have to go that route but at least it is an option. My realtor has a mediator with short sales (of course with a $250 fee)that has a reputation of providing "quick" short sales. The short sale will be the last resort. --75.185.xxx.xx

If the issue is that you need to be able to show that you actually sent a letter, then 1st class mail with certificate of mailing receipt is enough for court.

I don't know Ohio law. Generally "tenant's rights" prevail in a transfer of ownership - meaning the new owner must honor the existing lease.

You also must comply with Sec8's requirements for notice and ending the lease.

Why inform anyone of speculated sale - they need 30 days notice when it does sell, is this tenant interested in buying - HUD has some great programs to get them into the water even if it is a sinking ship, your personal effects will be off this unit. --76.241.xxx.xx
