State Specific Question About: NEW YORK (NY)

My neighbor had a small fire in the back of their house. To get to the neighbors back the fireman had to go through my tenants back door. They damaged the lock gate to the outside because the the tenant was too slow using the key to open the door. There was also some siding on my building that they pulled down. The fire was labeled suspcious. Is the next door neighbor responsible for my repairs or should I just go through the insurance company. The cost of the repairs and my insurance deductible are about the same. --74.73.xxx.xxx

The neighbors insurance should cover this in my opinion. If they dont have insurance, the neighbor should cover it. The siding I'm not sure about, did they pull it down cause they were sacred the fire would spread? --98.94.xxx.xxx

Ins Cos now keep a "permanent file" on your house, like a CarFax. Potential buyers and even you could have trouble getting ins.

Keep YOUR ins co out of it.

Their ins probably covers damage to neighboring property, landscaping...

I had a similar scenario, except it was a larger fire. I don't know what kind of policy the neighbor had, but her insurance did not cover her due to arson by the tenant. I sustained 15k worth of damage which I claimed. My insurance verified with her insurance her lack of arson coverage and just told me to follow thru on the claim since I would never get anything from the tenant responsible. I had no problems from it...no skyrocketing rates, no dropped coverage, etc....

Now, having said all that, I would still avoid making a claim if possible. I just couldn't suck up the 15k myself. --74.212.x.xxx

Will not raise your rates, unless you have many claims.
