State Specific Question About: OHIO (OH)

I have a tenant who has not paid rent on time since moving in, the tenant is currently has not paid February rent and March is fast approaching. Can I post a seven day letter and then file for eviction in March? --198.208.xxx.xx

It's a 3-day notice in Ohio, which must say:

“You are being asked to leave the premises. If you do not leave, an eviction action may be initialed against you. If you are in doubt regarding your legal rights and obligations as a tenant, it is recommended that you seek legal assistance.” Post it, hand it to them, and/or send certified. On Day 4, the landlord's complaint can be filed.

It's really important that all the I's are dotted and T's are crossed. Since you're unfamiliar with the process, you probably want to partner with an attorney by the time you get to that point.

You can find specifics under Chapter 1923 of Ohio Revised Code.

Be sure that the type is in the perscribed point size and font. Also check your area. In mine the judge is hard on LLs, though he is one himself. If I post on Monday I say that they must be out by R and I file on F. Don't get thrown out on a technicallity.

You are already 21 days late, you can only recover one month of late fees and rent - unless you have charity funding you need to speed read local and state laws, hire a flat-fee eviction service - should cost about 350-400 both actions. --99.160.xx.xx

Hamilton County actually has a 3-Day notice form on the Clerk of Courts Website. It has all the required language in it. All you have to do is fill it in, print it off, and give it to the tenant. Check if your county has the same.

Make sure you do not put it in their mailbox. Putting it under the door, serving in person, or taping it to the door is acceptable in HC. --74.215.xxx.xxx
