Hello, I am about to send a 5 day pay or quit to my tenants. $1800 was and is due by the first of every month. THe problem is they paid me $1000 on the first and $600 on the 5th, so they still owe $200. For 3 days now they are not getting back to my phone calls or emails. They were late the past 2 months also and we gave them a break. I called JP court and they said the wording on the 5 day pay or quit has be very very correct or it will not hold up during the eviction. Can anyone explain what exactly NEEDS to be put on there. Is there any problem with the face that they paid most the rent?

Local courts may have local requirements.

1. Contact your local RE association.

2. Have any LL associates - ask them.

3. Stop by an apartment comlex that has onsite managment and ask for a copy.

I collect ALL or nothing - IDK your state laws - but in NJ by accepting a partial I put myself in a bad - gray position !

Especially if you wind up in court -

you need to check you DE rental laws in regard to your acceptance of partial payment.

Check your state law that requires you to serve a 5-day notice. It will specify what the tenant must be notified of.

Pull up the landlord tenant code. It's pretty straight forward. just google. it I use it all the time. Where in De are you? Mine's on UD campus so if they are late a few days I still have mom dad and the other roomates on the hook. So I collect the late fee and let em know I will ruin The whole famile's credit with an eviction and court fees. usually get it with late fees (5%) within the day or two.
