Take someone with you if you have to go to the apartment. Without a witness, it is just a he said, she said story.
The only way you can get her out in this state is if she pays late all the time and you have a record of that. Or if she does not pay. If you are near Trenton, look up lawyer Joe Mooney. He is probably the only lawyer around here that will work to remove someone. --76.99.xxx.xxx |

To some of you thanks . To some of you yes two side of every story , and no it's not april fool . I am the owner of this building and she will say that she will suit me any chance she gets , steeling my property as , picture frames on the walls of the hallways plants air fresheners furniture in the hallways , telling me that I am a drug attic , I belong ............,some of her family are police man. calls the fire department when ever she likes and for any reason , one , the battery in the fire box went low and the unit makes a buzzing sound , she called the fire department telling them there was a fire in the building , should I go on ? Police in the state of NJ do not get involved with landlord tenant issues . She does not have a lease and as per the NJS she is on month to month , and she is not asking for a lease , cannot force her to have one . She also refuses me to go in the apartment to do repairs , she told me she does it , and then calls the city a complains and I get a fine if I do not do the repairs and have to hire a contractor .I am just adding to the madness:-). --67.82.xx.xx |

If she is on month to month, just give her a 30 day notice to terminate the tenancy. You supposedly do not need a reason. Perhaps you need the apartment back to renovate it??? Check with a landlord/tenant lawyer.
Granted, not paying rent is the easiest way to get rid of someone. Any other reason, the courts sometimes give tenants a time to "cure" the problem. So if she is abusive and uncooperative and you use that as a reason, the court might give her a chance to "cure" or correct the problem. So it's all for naught.
Yes, she is a nightmare tenant and you should talk to a lawyer on getting her out because she is a nuisance tenant.

We all learn from experience and have had nightmare tenants. Better be more selective next time and pre-screen applicants and have written rental criteria.

Franco can't just give her a notice to leave in NJ. There has to be cause such as nonpayment or late payment consistently. He should try to get her to sign a lease so that there is a document that she can violate.
Franco, get one of those lawyers to draw up a lease and send it to her so you have some rules to work with. I had one like this. Take her to court yourself if you have to but I really suggest that you try Joe Mooney down here in Trenton. He will find a way if you have enough money to pay his fees. So she called the Fire Department saying there was a fire and there was NO fire? That has to be illegal and she was disturbing the peace for the entire building. My dear AllyM , Joe Mooney was advising her when he was working for me on other issues with other tenant . Trenton is a bad town to own , the NJ tenant association has more power than a regular lawyer and they have the baking of some political ............ , I am just venting with the hope to get some feed back from others so maybe I can find a solution to this madness . AllyM , you asked about the fire alarm . Yes she called saying just that . I drove one and a half hour to find the fire department laughing at me they thought my wife made the call . I do not live in the building . She has called the local police where I live to come and look for me for sewer back up and when I get there nothing is happening .Over 2 years of this and I have had it . If I had not gone to the law about this , I could have dealt with it the old fashion way like my GF used to do in Queens NY, too late for that now . --67.82.xx.xx |

You Just have to play the game with this tenant. But it will cost you along the way since you will need to file in court probably more than once. You can force her to sign a new lease, and make sure you raise her rent the max amount at each anniversary. If she hit you, you would need to lodge a complaint with the police and receive a conviction before you can evict her successfully. --67.85.x.xxx |

I am sorry CTLL never did tell you what lead to this . I was working installing a new sink and cabinet in one of the apartment , went outside to my truck to get a tool and on my way back inside she confronted me about some lights that were out in the hallway , I new about it and was going to take care of it as soon as I was done with the sink . She said "when a F.....K are you gonna change the lights poor excuse of a landlord, drug attic ". All in one breath . I ignored and went in to the apartment I was doing work at , thirty seconds later the door opens and I feel getting hit from behind on the side of my face . So far, getting cussed out was the worst, besides d*ath threats, one on voice mail. And vandalism against my truck the night after calling the pound on an unauthoriyed pit bull in a unit one tenant broke into as it was twice the size. STAY AWAY from that person. Evict.
