State Specific Question About: CONNECTICUT (CT)

My leases state that rent is due on the first. The problem is that in CT, the tenants are given until the 10th to pay before landlord can file a notice to quit or charge late fees. All three of my tenants in one building have begun paying later and later, usually by the 9th or 10th of the month. I'm getting really aggravated by this but am unsure of what can be done about it. I've thought of writing letters to them reinforcing the due date, but there really doesn't seem to be much I can do to penalize them. In this market I don't want to threaten to not renew their leases. Any suggestions. Two of them are on Sec 8 (I know many don't like sec 8, but it has been working for me otherwise.) I thought if I wrote a letter I could CC the housing authority in hopes of scaring them into paying on time. --98.179.xxx.xxx

We discount the rent $100.00 if paid early, in other words the day before it comes due....

We then add a $10.00 a day late fee after 10 days...

Should be legal in CT..

My $10.00 per day late fee begins on the 4th day and ends on the 10th. On the 10th, the pay or quit notice gets posted. I have one tenant who pays every month near the 10th but she pays those hefty late fees and the full rent.

There is really nothing you can do about getting the rent by or on the deadline date. Make sure you have a late fee if rent is not in your hands on the 10th day of the month. That will cure some tenants but not all.

I have one tenant who sends his check early so I get it on or before the 1st of the month. I get 4 checks several days after the first of the month. And I get one check hand delivered always on the 10th day of the month.

I had one tenant who consistently paid after the 10th because of his payday period. So I always got the late fee of $25.00. It didn't bother me as long as the rent got paid and was current.

He finally moved out (Nov.31st) after 7 years. He was paying 600.00 plus 25.00 late fee (every month). Now the apartment is for rent for 650.00.

Make sure your late fee is in a separate category and doesn't get included in the rental income when you do your taxes.

I would inform them that even though the state allows rent to be paid by the 10th before late fees apply, etc., rent is due on the 1st. If another LL, business or mortgage company does a reference check you will report the truth...their rent was paid late every month.

As already stated by CT landlords, there's nothing that you can do if the tenants pay by the 10th of the month. Do not send a letter to the Housing Authority demanding rent be paid before the legal grace period ... it'll get you nowhere.

Changing the rent due date does not help because the tenant has 9 days after the rent due date to pay without penalty/late charges, etc. Change the due date to the 10th and the tenant has until the 19th to pay - Notice to Pay or Quit can't be served until the 20th.

Sec. 47a-15a. Nonpayment of rent by tenant: Landlord's remedy. If rent is unpaid when due and the tenant fails to pay rent within nine days thereafter or, in the case of a one-week tenancy, within four days thereafter, the landlord may terminate the rental agreement in accordance with the provisions of sections 47a-23 to 47a-23b, inclusive.

Sec. 47a-4. Terms prohibited in rental agreement. (a) A rental agreement shall not provide that the tenant: ...(8) agrees to pay a late charge prior to the expiration of the grace period set forth in section 47a-15a or to pay rent in a reduced amount if such rent is paid prior to the expiration of such grace period; or (9) agrees to pay a heat or utilities surcharge if heat or utilities is included in the rental agreement.
