State Specific Question About: VIRGINIA (VA)
Do we HAVE to provide the tenant the 24 hours after the eviction to remove their personal property or can the stuff just put it on the sidewalk? --98.140.xx.x |

Depends on how far along you are in the process...what does the sheriff say? --65.40.xxx.xx |

Wow, 24 hours? Here in MO the sheriff schedules a "be out or throw out" date, and it's usually another 5 - 7 days after the court date.
You can't throw anything to the curb without due process. Contact the sheriff or whoever is responsible for making sure they are out and ask. Do it right or you may end up owing for the tenant's trash that gets stolen, rained on, snowed on, etc. And they'll claim they had a 65 inch plasma that you "stole." --70.129.xxx.xxx |

When the sheriff shows up he will make the call. If there is not much stuff and you have the people and its not raining then generally he will allow for a set out. If the set out will take all day due to lack of manpower or volume of stuff then they will do the 24 hrs lockout. Call and talk to the sheriff to see what they say. If you do the lockout then the stuff not picked up is yours. It can be a write off if it is donated to a charity. --146.165.xx.xx |
