I think the answer is "gotta evict him" but.... seems to be a danged if I do, danged if I don't, as I'll be looking for at least one new tenant either way.

Once a single family home, now a chopped up 4 unit with heat included in the rent as it is central air and all connected.

Scenario: one tenants smokes a ton of pot which gets pulled into return vent and "distributed" to all units. One tenant is complaining about it. I have sent a letter to pot smoking tenant asking for them to stop... they have not. I have not noticed the smell myself, so all info is 2nd hand, no other complainers (that have spoken up) from other units....

Have a meeting with a member of your local drug squad. They may not want to make a bust on a casual user. If not, ask them if they would accompany you to the door while talking to the tenant about "alledged" MJ usage. Just the cop in the door should be enough. --141.129.x.xx

I agree with the others. I would let the other tenants know to call the police when they smell the odor. Maybe talking to the police will make him smoke it at another buddys house.

I recently had the same problem in my four flat. It seems that a tenant was going in the basement to smoke and the smell was going up in to the first floor rear apartment. I simply sent an e-mail to all tenants stating that I had received a complaint and that I did not want to know who was responsible but that it needed to stop or I would be forced to close off access to the basement and laundry facilities. I've not heard any more about it, so I'm assuming it has stopped. --199.67.xxx.xxx

Make the building non-smoking as part of your lease...for all varieties of smoke. If you have a free standing garage make that non-smoking too. Tell your tenants it's for insurance purposes and the health of non-smoking tenants (allergies, etc.) State that any tenant or visitor who wants to smoke has to do it outside and not within 25 feet of any building...see how secure he feels in a corner of the yard lighting his weed. This is why I never went into multis. If not this issue there is always some other issue. You are not a cop nor their dad to control everyone's behaviour. People just can't get along. Everyone has a different schedule and soon there will be complaints about noise or other things. I would stay out of it. Tell your complaining tenant to go solve it themselves by knocking on the door and talking with the person causing the problem just like if they owned the place. Your job is to maintain the building and collect the rent period. What if someone is watching TV late at night too loud, what if someone has a quest that honks on the street instead of ringing the door bell etc etc. Stay out of it, it never ends. --12.161.xxx.xx

I am trying to stay out of it, already told them I'm not a referee......

I like telling tenants to call police directly.

I like non-smoking lease idea.

I agree with collecting rent and maintaining. Easier said than done sometimes.

I advertise my units as "maintained as a nonsmoking residence". The lease states a few times the rent goes up by $XX and an additional non refundable fee of $XXX will be charged if smoking is allowed indoors.

In some places you cannot advertise "no smokers". But you can always describe your property as "maintained smoke free". You can even use a green environmental tree hugger tag or logo. --141.129.x.xx

Does GA have a medical pot law?

Because both of the states I operate in have medical MJ laws, I can't assert that pot smoking is illegal activity and I cannot evict for it. Because I can't demand to know if it is medical, because that is confidential medical information!!
