I always understood that you are to ask the same rent amount for s8 as for a unit as non s8. I don't know if this was a legal matter, or something in the HAp contract or lease addendum. I know that each area is different with s8 and what they pay, and around here often s8 will pay more than market, sometimes alot more.

There are several propery managers around here that have a clause like this one (taken right off their website)

***Properties participating in the Housing program are subject to rate increases due to owner responsibility for utilities and inspections.***

Is this ok to do? So if I have a 3 bedroom apartment right now for $675 and somebody s8 comes along, with the same utility payment requirements, could I charge them more due to inspections, etc? --71.251.xxx.xxx

I think the language you quoted suggests that your Housing Authority requires the LL to pay utilities. If a LL normally does not pay utiltiies but has to for his Section 8 Ts, then he can charge extra for that additional benefit.

I don't charge extra for Section 8. My Section 8 Housing Authority knows the market and does not pay above-market!

Jason, I don't have any S8's but I know that in where I do business in PA they do pay above market. Yes, you are suppose to charge the same amount as you would to a non S8 but that rarely happens. Most LL's get around this by having a side deal with the tenant where there is an agreed to higher rent which is on the lease and then typically the S8 is only responsible for a small (or zero) portion of the rent--but since that portion is based upon what is stated in the lease, the S8 typically ends up paying nothing or the LL gives them a kick back monthly. Either way, the LL ends up with more in their pocket each month.

S8 does not require utilities to be included. All of the above, without question, could get you in legal trouble. I personally set a price for the apartments and that is what it is for everyone. --167.219.xx.xxx

Note about side deals with S8 tenants. S8 is a Federal program administered at the local level. Some of the forms you sign (created at the federal level)say you will NOT do a side deal. The Landlord can (and have) been procecuted for fraud, tenant will lose vouch if discovered. FYI --71.191.xxx.xxx
