I don't think you can put a clause like that into the lease (you would have to go to court anyway to get them out). Once they get behind, serve the 5-day Pay or Quit when they get behind and don't let them get 3 months in the hole. --98.212.xxx.xxx

What does the lease say about this now? Most leases will have a 3-4 day grace and after that you must begin posting the cure/quit notice, follow quickly to eviction court, there is no reward for waiting, most courts only reward one month rent cycle plus damages. --76.241.xxx.xx

This is what I put on my leases "Tenants should pay no later than the 1st of the month, if rent is paid late three times in one year this lease will not be renew" ever since I been doing this nobody has been late. --4.159.xxx.xx

John, Please don't wait 3 months!

First thought: you don;t need a clause like that. State laws generally already say "if you don't pay, you go".

My style: You can write anything you want and sometime the tenant will comply, even if it's something a judge would not honor.

My lease states: "Resident agrees in advance to peacefully vacate within 4 days of management's final notice."

There is no Indiana law that says they must comply, but I show them the lease copy where they agreed and some cooperate. They'll say "OK, but could you give me 5 days?"

Best advice: don't let them get behind. We deliver late notices on the 2nd and evict on the 10th. Got rid of grace periods years ago. No one complained. --67.175.xx.xxx
