State Specific Question About: IOWA (IA)

I have tenant doesnt pay rent. I gave 3 day-notice to cure or quit. She went to legal aid whom sent me a letter stated that I over charge her late fee. She did sign the lease with me if rent receive during 1st-4th rent is $450; if pay after the 4th rent is $500. Letter said this tenant will waive to claim against me if I do not file eviction.

Go to the top of this page and read all there RE: Iowa state law. Find out what Iowa says about late fees . If the lease says $50 and the tenant signed it unless Iowa says something different go right ahead and proceed with eviction. Also since your tenant has lawyered up it would probably behove you to consult your own attorney. This is one of those cases where the low lifes get free legal services paid for with your tax money and your attorney is paid for by you. You get screwed coming and going --99.151.xx.xx

File eviction. Let her claim all she wants.

Tell her, her time is done and if she wants to fight youve got a lot bigger guns than she does and one way or another she is out, so start packing.

You might also check your state law regarding discounts. Some places only allow a specific ratio. 10% seems reasonable.

I am in the process of rewriting how we do things to charge a discount if paid in advance, and a late fee if late. The way I'm doing it is a $25 discount if paid by the 25th of the previous month, and a $25 late fee if not paid on the 1st. It's still $50, but this basically allows me to advertise a lower rate, but still get the same I've been getting, and still get a late fee if late. --76.87.xx.xx

States allow an interest rate, and you can not exceed it.

If you discount your rent for an early payment it might fly.

Again this is state law, and you may be in court. People are sue crazy, and Attorney are fee crazy,

INDIANA, the legal rate of interest is 10%. Presently there is no usury limit; however, legislation is pending to establish limits. The judgment rate is also 10%.

IOWA, the legal rate of interest is 10%. In general consumer transactions are governed at a maximum rate of 12%.

Iowa has no usury rate limit listed. but you do have a maximum rate of 12% --67.163.xx.xxx

This atty letter sounds very generic, proceed to study local and state laws that apply to this and move forward as mentioned, reduce the fee in court if needed to gain possession - you need to get your unit back and re-rent after repairs are made at the former tenant expense. --76.241.xxx.xx
