State Specific Question About: ILLINOIS (IL)
I have 3 adults and 4 children under 14yrs old living in my house. I invited them to stay for 1 or 2 months to get them off the street. Its been over a year and they will not leave. They do not pay for anything or offer money for rent, water, electric etc. What am I to do? Can I have them removed under the trespassing rules or something else? --216.240.xx.xx |

With no lease or rental agreement, technicaly they are tenants at will. You will have to file in LL-Tenant court to evict them since they have established residency. If you are unfamiliar with that process, find an experienced LL-Tenant lawyer to handle for you. --96.239.xxx.xxx |

Step 1, even if you are well versed in the law, would or should be you having a specialist law firm do the serving.
With no contract and no payment ever, call the sheriff's community relations person for a chat. Then explore if your wife could file for a Restraining Order?
The home owner can say when this got to end.

I was in LL court, observing when a wheelchair bound old gentleman was battling freeloaders. Mother and pregnant daughter and they were given 10 days to move out.
You gotta bring friends to witness and document all your possessions. such folks are likely to loot all you got. And sleep with the car keys under the pillow. It's not GTA if they take your vehicles. I had a lodger once. ask me how I found this out! --125.27.xx.xx |

By "my house" do you mean the same home where you live? Is it a seperate apartment in the same building?
If mingled inside the same place you live/sleep/eat/shower, they are roomers and flal under different guidelines. I suggest giving a written 10 day deadline. If not out, set their stuff on the front porch and change the locks. (like my neighbor did when she caught her hubby cheating I wondered why she was dumping gold clubs out of the bag onto a pile of clothes in the driveway!) --67.175.xx.xxx |

u can usually evict easily if month to month (no lease) .see atty if u havent evicted before.give no reason for eviction or say relative needs apt .always get credit report before renting to anyone.ck last 2 landlords if possible and court and police or criminal.u must be new at this.u cant just let people walk in off the street into your apt. --173.14.xxx.xxx |

We live in Franklin County. I posted this message last night to help a friend of ours It is her house and she let the people in to stay with her. 2 adults, 3 kids. They moved in another guy. Now they ignore her request to move out. We'll have to help her find an attorney for the eviction process. She was trying to be nice so the kids wouldn't be on the street. If she lives in the same house she needs to inhale deeply and blow all their stuff out the back door then change the locks, if they are not paying for anything it would be hard to prove they live there without any trace to the address like utility payments they do in CA. --76.241.xxx.xx |

Well, the problem is solved. It took them 4 hrs. to move out. I guess they didn't like it when confronted with the question they may be getting money from welfare to pay for bills and rent they may have falsely turned in. Musta been true. They took off like a pack of rats on a sinking ship. Good riddance. Now our friend has her house back and she can live in piece and quiet again. Thanks again. --216.240.xx.xx |
