State Specific Question About: MISSOURI (MO)

Our tenant (single male) is having trouble with bills and wants to have a male roommate move in. It is worded in our lease "there will be a $50 charge per person per month whose name is not on the lease for anyone staying over 15 days in any 100 day period".

I believe he should pay the $30 background check and sign a lease also. Is this correct?? Since he would be moving in 5 months into the lease how do we write the dates on the new guys lease? Would his lease period end when the original tenant's ends, ie, August 1?

If the new one wants to be added onto the lease as paying jointly and severally, yes credit check, if only added as a random occupant then no - this allows the occupancy under control of the first - she/he is the one to decide the rent assistance occupant, however if you feel you want the new one then ask for it, I go thru this many times with students and do not want to evict the new one, if the first one goes the second one must - period. --76.241.xxx.xx

I'd need to read the entire lease, but I think your lease provision basically authorizes the tenant to bring in a roommate without your approval and without adding him to the lease.

So I don't need to do a credit or background check on him unless he is signing the lease?

We can collect the extra $50 per month since it's in the contract if he planning to stay for any extended time...right?

I just thought a background check (to check criminal history) would be necessary to know who we have in our building. I guess the credit check would not be necessary since he would not be on the lease.

Who wrote your lease? What's the purpose of the "$50 per person per month..." clause?

Usually, the charge for unauthorized persons is higher--high enough that the threat of being charged that amount is enough that tenants WANT to add people to their lease if they are living there.

YES, you want an application from anyone planning to live at the property. YES, you should check the app just as you did for the first tenant, and YES, you should write a new lease with the new tenant added --71.158.xxx.xx

Always good questions here.. and a variety of answers..

1st. step.. Know your MO laws..!!

2nd. the lease;

you wrote:

often if you read the reverse.. it looks different.. just like someone asking

'did you mean this'?

IF IN 100 DAY..

THEY STAY OVER 15..

(SO NOW THEY ARE OVER 3 MONTHS OF TIME)

You want to charge 50 only 50 for each person. Gee you have a 3br home.. thats 6 adults under Federal guidelines and then kids.. pretty cheap..

A. Anyone that is not on the rental agrement is a guest. If they are there after the tenant leaves, and with the tenants ok.. they are a squatter. eviction time in most states.

b. guests stays are limited to 10 days unless the LL agrees in writing..

c. this protects you from someone claiming to be a tenant..and staying.. so you have to toss them..

d. yes you want them jointly/severaly so you have everyone there with a background/credit check.. they pay for as you are considering a change in your lease..

FYI...We have a 2 bedroom duplex not a house. If we approve his credit/background check and if we rewrite the lease to include both names then the new guy wouldn't be "unauthorized". Karen, when you rewrite the lease, you can raise the rent. If you want, that is.

another dumb question.....should I write the new guy a month to month since the original lease is 1 year that ends August 1. Or rewrite lease for original renter AND new guy for another 12 months effective immediately. I'm thinking letting the new guy do month to month until original lease ends and then go from there. --99.88.xxx.xx

Huh? We are talking about 1 unit, right? 1 unit needs 1 lease. Both tenants are on it. Rent is owed "jointly and severally"

You can make the new lease month to month, end it on the same date as the original lease, or do a new 12 month lease. It's up to you. --71.158.xxx.xx
