A repairman made a point to 'tell' me he slipped on the ice at one of my rental props today. I was there several days ago and saw no ice and none of my tenants reported any ice issues...Please advise regarding my personal liability on this?? Thanks

1. Make a diary entry immediately as to the date that you were there and saw no ice.

2. Go over there ASAP and check to see if there is any ice there now. Take photos, and date them, Make a diary entry for today's date and mark the ice status down.

3. Talk to tenants, ask if there has been any ice that they know of. Write down their names and answers.

As a general rule, you are responsible if you knew or should have known of a dangerous condition (in this case, ice) and you failed to take reasonable precautions about it. If the ice was from the weather, there is generally less need for you to act than if the ice was caused by your own conduct (for example, from a leaking hose that you failed to fix onths ago).

There are also issues as to whether thecondition was obvious ("patent") or hidden ("latent").

And, why this repairperson was not taking normal care to keep from slipping. In the winter in "northern states", ice is pretty normal, isn't it?

i find it useful to ck for ice every am at the property i live in and rent.snow melts and refreezes to black ice.i take ice melt with me and tell tennies if there is ice after i apply ice melt.i am back at noon to shovel and scrape .nothing is too good for the tennies. --173.14.xxx.xxx

Ice is an Act of God and if he was not wearing PROPER FOOTWEAR. It's his problem.

Maybe he was just letting you know so you could protect your tenants from falling.

A little ice melter or a box of regular kitchen salt should take care of it. Or you can get some builder's sand. Do not use cat litter. It's clay and becomes slippery when wet. --76.99.xxx.xxx
