I have a Tenant who has paid nothing for this months Rent. No one has seen him in the last 3 weeks. I have called him on his cell phone and left message after message telling him to call me. What should I DO?? --76.197.xxx.xxx |

I had a problem like this. I have done 2 things. Posted a note on the door asking for him to call me. This has worked.
Posted a 5 day notice on the door. It may not be leagle to post it just on the door. but at least it will get their attention. They can then call set up a time to meet you. I then have a new 5 day notice in hand at that moment. I hand that to them and tell them it only goes away if all is paid in full before the 5 day expires. --67.175.xxx.xxx |

Since they have not paid rent, begin eviction proceedings.
If you live in Cook county, contact a lawyer. If you live anywhere else, read on.
Find out if they are still living in the unit. Is there mail in the mailbox? Are there tire tracks in the driveway/footsteps to the door? Call the utility companies and make sure the utilities are still on. If the outward signs point to abandonment, enter the property to ensure the heat is set at a reasonable level to prevent freezing pipes. When you are in, check for possessions/food. Is the milk expired, and the bread moldy? Then you have a strong case for abandonment. Post the notice on the door per 735 ILCS 5 Sec. 9-211.
"Service of demand or notice. Any demand may be made or notice served by delivering a written or printed, or partly written and printed, copy thereof to the tenant, or by leaving the same with some person of the age of 13 years or upwards, residing on or in possession of the premises; or by sending a copy of the notice to the tenant by certified or registered mail, with a returned receipt from the addressee; and in case no one is in the actual possession of the premises, then by posting the same on the premises."
If the property isn't abandoned, hire a process server to serve them.

One you can't post in this state unless no one is living in house and a lot of judges won't accept a posting.

I hate to say this but, " three weeks in this weather!, are you nuts"? Good lord man,give it up on phones and emails and talking to his friends. Get your butt over there ASAP, and call the power company in route. Use your pass key if they don't answer the door, you do have a pass key I hope. Crack the door an inch or two and start yelling LANDLORD. If he is home , or in bed or what ever, just tell him that some one reported him missing and you were concerned about "his" health. I have done an Eviction before, but every time they can't serve the Evictiion it cost more money. If hes never around how would he ever be served the Eviction, or How much would I need to pay before he is caught up with? --99.140.xxx.xxx |
