can a lanlord seize property for delinquent rent and can the landlord keep the deposit in lieu of delinquent rent?

No you can't seize property unless you have a judgment and then put a lien on the property. Here you can deduct rent owed from SD. Get a copy of the book , " Small Claims Court , How to Collect The money you Won" It's available on this site. From your question I'm guessing that you don't have a clear understanding of the laws of your state or being a Landlord in General. That could end up losing you lots of time and money. Go the LL/ Tenant state law section of this site and read all you can RE: Your states rental laws. --99.117.xxx.xxx

odd questions - you need to wise up on the proper procedures. The clock keeps ticking and every day a tenant gets away without the LL taking the proper steps is bad.

Hire a flat rate eviction law firm to do the serving. So you pay $ 50 or $ 100. Plus the eviction, if needed.

Your mistake is that you have the wrong ideas and wrong priorities. Without the proper notice, your tenants win financially. It's the 20th, so you wasted some 15 days already. By the time they are out, your SD won't cover the money they owe.

Hope you will do the right thing and stop the bleeding. Act now! Good luck and welcome here, even if you get tough love (I hate tenants benefiting from non payment games, you know) --125.25.xxx.xxx

It sounds like you are unsure of what the laws are, I think everywhere you get into instant trouble for forcing out a tenant without using a court order, use this guide updated in July but also check with local library for local court rulings --> www.azsos.gov/public_services/publications/residential_landlord_tenant_act/ <-- and if you need it quick for the first time best to use flat-fee eviction service, here we get both actions for 350-400bux. --65.43.xxx.x
