State Specific Question About: TEXAS (TX)

I have a contract on a house that has a Tenant. I thought at first they wanted to stay and now they are not sure. I understand the eviction process when I have them under a lease, is it different if I buy the house, they don't sign a lease with me and have not paid the rent? Is this a foreclosure? In that case you probably don't have to honor previous lease. Otherwise you will probably have to honor lease.

If this is an investment property. I'd try to get them to stay, the renovate in teh future when they move. --76.87.xx.xx

I'm not a TX attorney, but I id stay at a Holiday Inn so here' my advice:

My state requires foreclosure with attorneys in the big court with a several month delay, not a simple eviction.

Talk to them and work it out. The goal is cooperation. Be calm and ask "You know you're behind and I can't carry you any longer. What can we work out? Can you be out by the weekend?"

Paying their deposit on a new place if needed is CHEAPER than going to court and the lost income during the process.

Our state requires they sign and notarize a RELEASE OF INTEREST IN LAND CONTRACT so you can sell the property someday. --67.175.xx.xxx

There is no lease. Fannie Mae owns the home. The tenants are still there & so far no one has provided the status of the rent. The listing agent says they are trying to ge the name of the management company. --76.184.xxx.xxx
