State Specific Question About: MISSOURI (MO)
Do I as a prospective landlord need to return application to tenant I did not select. Do I keep these or return. If return do I need to get a receipt. Application was not formally screened (not sent in to screeners) since applicant did not meet our criteria. Thanks Deb Parsons

We do not return application that have been brought back to us. But some people just pick one up and never return them and now we request anyone taking application that they return that application only if they are serious in renting the property. I do not charge an application fee as such. But the majority of my applications are never returned. So I plan to start charging $5.00 for the blank form, then refund the money when the completed application is returned to me. That will save me lots of paper.

Local prop manager requires ALL monies be included WITH the application!! He GETS it!!
Local landlords charge app. fee, up to $50.00.
That gets rid of the bad apples, generally.
I advertise "BACKGROUND CHECKS REQUIRED!", which helps avoid some altogether--they don't call. Also have a short "phone question list" which gets rid of prob 70%-80 within 2-3 minutes on first call, but which won't scare off a good tenant. --24.165.xxx.xxx |

Opinionated, paper is cheap enough that I still give away my applications!
I don't charge an application fee until after I have already reviewed the application and not found a reason to reject it. If it passes my review, so that I'll need to run credit check, civil and criminal backgrounds and start the employer/ landlord verficiations, then I want some $$ for the costs and time. My application fee is NOT refundable and is NOT credited against the move-in money, but if someone made an issue of it, maybe they could convince me to credit it against the move-in money.

I forgot to answer the OP's questions -- I keep all of the old applications in a separate box for rejected/withdrawn applications. When the box is full, I write the date of the most recent application on the side of the box, and write a "shred date" on the box -- four years after the most recent application in the box. Whenever I notice the box after the shred date, I'll shred the contents.
Four years seems a reasonable time, to me. I have not looked up the Statute of Limitations for housing discrimination, but if I haven't heard anything in four years, I figure I'm reasonably safe. And because I have tenants of most races, religions, and various national origins, with kids, without kids, etc., I am not too worried about discrimination charges.
