Our next-door neighbor's tenants (who looked to me like meth addicts and/or dealers when they first moved in) got arrested last night. The police were there for hours in the middle of the night, searching for something.

We emailed the landlord to let him know what had happened, but I don't know how he has responded, if at all. This made me wonder. What should a landlord do whose tenants get arrested? Is that enough to justify an eviction? We are all month-to-month, so I know what I'd do. But what if you have a lease?

A lot of people get arrested for many different reasons. It is not the responsability of the landlord to police tenants for things they might have done off the property.

Years ago there were tweelve police cars on and around my property. I parked my car down the block and walked up to an officer who was doing nothing but standing alone, and I tried to ask him what happened since I was the landlord. The lead officer, Rafiel Perez, who was speaking with one of my tenants some 30 feet away from me, told me to shut up or he would arrent me. This officer turned out to be the bad apple from Rampart Division, that the TV show, The Shield, was based about -- all bribes..... I went to the station the next day and still no one would tell me what happened on my property. So since I'm not informed of any problems with any of my tenants, I can't take any actioin. --173.55.xxx.xxx

It gets stressful when a tenant gets arrested. I don't think there is a generic answer to what to do. I have it happen to me and I look up the docket sheets online, that tells me the lawyer, wherre housed, offense. --98.111.xxx.xxx

If they don't get bail and don't pay the rent they should be evicted. Hopefully the eviction will take place while they are still incarcerated and their stuff can be put in storage and the locks changed and then the landlord will be done with them.

depends what they are arrested for.a guy up the street was arrested for selling hard drugs;cocaine,heroin etc. the owner got a temporary restraining order barring him from the property.in a few days he was gone.he could have argued the restraining order but most dont from what we hear.local laws prevail.landlords cant tolerate hard drugs in bldg.they could lose bldg. --173.14.xxx.xxx

Tenants are arrested all the time. We'd faint if we knew what all went on in our homes.

I put such a tenant on our "watch list". He now has less money, might lose his job, eeds to pay an atty, girlfriend move out...

My tenant was arrested on a felony charge of impersonating a pain clinic employee to illegally obtain pain medications. This only happened last week, so she has not yet gone to court. I don't know if anything illegal actually happened on the premises.

I am also in fear of collecting rent, but I don't suppose there is any action I can take right now. Even with a conviction, there is no clause in the lease that allows eveiction on that grounds alone.

It's more complicated because she is a friend, she has a baby I adore, and another on the way.

Today I'll serve a 3-Day Notice To Perform Covenant or Quit citing

dogs

illegal activities on the premises

My elderly aunt was doing a favor for a "friend's friend" by giving "Sally" a place to live temporarily while she was looking for a permanent place of her own. A short 11 days later we found my aunt dead on the floor. We also found out that Sally had stolen my aunt's jewelry and other possessions, and forged my aunt's signature on phony documents. One document was a phony "lease-to-buy" my aunt's home. Another phony document claimed she/Sally was to inherit everything my aunt owned. Sally stole my aunt's checkbook and continued to write checks out of my aunt's checking account after my aunt's passing. The police ordered a toxicology report on my aunt (which hasn't come back yet), and within a week, the police arrested Sally on grand theft and fraud, and she is in jail pending an arraignment (after the toxicology report comes back). Of course our biggest concern is finding out what really happened to my aunt, and moving forward. We know it's going to go to court which terrifies us, but in the meantime, what should we do with Sally's possessions? Can we box them and give them to the police? --24.205.xx.x

Karen, I'm sorry for your loss, but in this situation I think it's wise if you spend a few bucks and get a lawyer to advise you. I think you have to store her stuff, though, so before you do anything with it, talk to a lawyer. That sounds like a tough situation. Good luck. --71.177.xx.xx
