State Specific Question About: MARYLAND (MD)
Most of my properties are in Virginia, but I just acquired some new ones in Maryland. Can you give me any tips about filing evictions in Maryland? For instance, in Virginia I have to give the tenant a 5 day pay or quit, then I file the eviction which gets set for court in about 3 weeks, if the judge gives me immediate possession, I have the Writ of Execution served by the sheriff. Any money that is owed I can go after via a garnishment. If the tenant skips out before I can file an eviction, I can file a Warrant of Debt and then file the garnishment.
What are the equivalent processes in Maryland?

I use the two step process in Maryland...
1. File court form for non-payment of rent...wait for court appearance, perhaps about 10 days, most tenants do not show, but if they do, judge may give them 5 days to pay...
2. No appearance or no pay per judge's order, another court form to file for eviction for non payment. This is anon court apperance, just a couple of days for the judge to sign off, and then wait for the Deputy to schedule the set out to the curb..perhaps a week or two for that to happen...
If they skip durng this process, you have to file in small claims court..if you can find them and serve them for that... --96.239.xxx.xxx |

St. Mary's County, Md--Court, judgement,one week later file for eviction. Wait for sheriff to call you to schedule eviction (could be a week or two, just have your crew ready to move the stuff out with a day or two notice).
If your tenant has not left by the time of eviction (and most do), then you have 1 hour and 15 minutes to remove all of the family's stuff outside of the house. The sheriff will wait during the eviction in case the tenants want to cause a problem. Bring enough people. We usually have 4.
Bring lots of heavy duty trash bags for clothes and stuff in the kitchen. Stuff has to be left outside for 24 hours. Then you have the pleasure of having the left over junk hauled away. Good luck! --216.36.xx.xxx |
