State Specific Question About: ILLINOIS (IL)

I am in the process of evicting a tenant for nonpayment of rent. Before I rented to her, I checked out her references. They came back fine. Now after doing some investigation I discovered that she used her mother's phone number and her mother's maiden name as her past landlord. Looking through property tax records, I found the real landlord. He told me that my tenant left owing him money too, & she told lie after lie to him. I feel like a victim because I would have never rented to her. I am also out of a lot of money. Is this a crime putting false information on a rental application? --98.108.xxx.xxx

On a bank loan it is,and you did extend her credit, but you and a bank are not in the same game, seems you are one of the little people.

With Justice the way it is they would do no time nor be ordered to pay you back, you may be considered the bully kicking her out,

If there is an art to this business, it's screening. From now on you will always check the court records to see who owns the property where aplicants live. Check the address on their drivers license too, it may not show up on the application. I don't know about the law. But I do believe that it is LL responsibility to check and verify information on rental application before accepting anyone into the property.

I usually check driver licence and proof of income. Make sure it is match with the rental application. If it is not, ask them for a reason. --69.249.xx.xxx

There are laws about fraud and maybe about obtaining credit under false pretenses, but what did it cost you because she did this?

Thats separate from what she owes you for lost rent and eviction costs, which you will be awarded by the eviction.

One time I called an applicants landlord and they called me back and left a message on my answering machine that the applicant, their tenant, paid rent on time every month and wasn't ever a problem. I saved the tape. I accepted the appliant who turned out to be a noisy terrible tenant. In eviction court their mother was there and had the same voice as the tenants previous landlord (answering machine recording). After I won the eviction and converted it into a money judgement, I filed a law suit againt my x tenants mother who lied about her daughters tenancy and rental payment history. The mother, not wanting a judgment recorded on her credit reports, agreed to a settlement. --173.60.xx.xx

I don't know about the crime part, but certainly you can take this and learn from it. Checking who is the owner of record of the address given on the application is the very first thing I do when evaluating a tenant prospect. Well it is a civil matter, not a crime in the sense of assault.. or theft..

There is a concept in law called a

'Statement in reliance'

and another called 'Fraud in the inducement'

You may consider adding verbage to your rental contract..

The Landlord will ‘expressly rely’ upon this information in deciding, so your following answers are ‘statements in reliance’.

All true and factual statements:

As the applicant, I further declare all the representations I have made herein are factual and no fraudulent or untrue statement have been made.

“Fraud in the inducement”, is a misrepresentation that induced a party to enter a contract they would not have entered

into in the absence of the fraud.

Even without all of these extra words, you are still entitled to rescind your agreement based on fraud in the inducement.

But that still doesn't change that you may not be out anything except lost rent and eviction costs, which you will recover from eviction court, and thus did not suffer from the fraud.

Check all of the above as well as all the references they put on the app. We do backgrounds on their references and that usually shows up the type of people they run around with. Many times they will apply in their kids or someone elses name so make them show you a copy of their drivers licence to verify who they are. --173.23.xxx.xxx

I called a 'landlord' one morning about 10:30 and asked her if she had any rental property. She sounded confused and said, no, she didn't have rental property. I apologized for bothering her and told her someone had put her number down on an application as a landlord and it was obviously an error.

She called me back a few minutes later and apologized and said yes, she did have rental property afterall but she 'forgot' about it when I called her. It was early and she was babysitting her grandbaby and she...just...forgot. Oh, and they just happened to be WONDERFUL tenants, btw. hahaha

I didn't even bother to call them back. They knew they were busted.

This is a good story, and a good reason to ask maiden name on the application, apparently you did not to the courthouse to check the docket or the previous eviction and damage award would be there - I say it often, check in person at the courthouse - many times there is nothing online when the case has not been heard yet or no settlement reached but you can dodge a bullet by taking 15-20 minutes with the clerk of court. --65.43.xxx.x

When I first started LLing (9 yrs ago) I had my 1st Sec-8 tenant. I thought she was a nice person but was under-educated and at a young age she had 3 children by 3 dif fathers. I thought she was just a single mother trying hard to get along in an unforgiving world. Her oldest hung himself at 14 on the tree in my property's yard. Dealing with the police, trying to get my property back (via abandonment) etc I learned she had 4 aliases and 3 SSN#s (2 she was using were from her kids). Gas and water were turned on in dif names. Kids enrolled in school under dif names, and she calling herself Mrs___ (the child's last name), so she was known as a dif person in each school. Social Services, Health Dept, former LLs, the courts, several lawyers of the father's of her children she was suing(and even men who she TOLD they were the father and weren't)--all looking for her under multiple names for multiple reasons. Not to mention she took the insurance money from the son's death and bought all new furniture on credit for her and the remaining 2 kids new life--and used my property address for delivery, stored it in my property till she could move it to her 'new place' and didn't tell the furniture store about the move. They would have never seen a dollar.

This woman gave me an education! Now I expect tenants to lie and defraud and I look for it in all the ways she showed me to look. --137.242.x.xx
