State Specific Question About: MISSOURI (MO)

Okay- I am on the flip side as I am a landlord myself with several rental properties. My daughter signed a lease in MO for a 3 bedroom apartment w/ den on the first floor last week.

She then received a phone call yesterday that the current tenants decided not to move. The manager also explained that she made a mistake as it was the wrong floor plan and was only 2 bedrooms. She said she has others available with only 2 bedrooms on the 3rd floor. She needs 3 bedrooms and preferred 1st floor because of children. She gave no deposit/rent and did not receive a copy of the lease. Is the lease still valid ? THANKS ! --72.160.xx.xxx

The landlord has violated the lease. Walk away with all your money.

I never sign anything but a deposit to hold until a place is actually ready.

Since your daughter didn't yet pay any money, it would be almost impossible for her to enforce the contract.

The manager sounds inept. Although it is very inconvenient for your daughter, she probably is better off living somewhere else.

Is there a clause that says it is void if landlord is unable to deliver the unit on the agreed upon start date?

Just to be sure I would have the landlord sign a release. This might be a property manager who goofed up and you don't want the real landlord thinking she backed out.

Did she suffer any economic damage from this?

Usually if no money exchanged hands the courts won't hold her to it. --151.213.x.xx

I am curious as to why you're asking about lease being valid? Is this PM trying to enforce it, even though he cannot provide the unit they agreed on?
