State Specific Question About: TEXAS (TX)

I am about to evict a tenant who is behind on her rent, but she made a partial payment on the rent after the judgement for possession and back rent was obtained. I have also filed for a writ of possession which gives us the right to remove her belongings and set them out at the curb if she does not vacate voluntarily. She is threatening to sue me for wrongful eviction if I go through with the writ of possession. I checked with my lawyer who says that I am within my rights, and checked with my insurance agent who tells me that my liability policy only covers me for personal injury types of claims and would not cover this. Does anyone know of any type of insurance coverage which would cover me from frivolous suits like the one she is threatening? --68.113.xxx.xxx

I thought if you took money while renter is still in possession after judgment you had to start eviction process again. I'm not an expert, just my impression from reading others posts. --98.93.xxx.xx

you can't , as far as I know, insure against stupid people. Most of these big mouths threaten to sue but never do simply because it costs money that they don't have. If the dead beat had any money she wouldn't be getting evicted in the first place --99.91.x.xx

Every state has a different property code. Get a book on the Texas State Property code and read the sections about eviction to start with. It is not long. (click the link on Landlord/Tenant state laws above; but get the book for your reference.) This is your business, invest a couple of dollars learning the basics. You'll save yourself many dollars down the road. Don't listen to people giving advice from out of state unless they are also experienced Texas landlords. --168.7.xxx.xxx

Sounds like the payment was not rent but was payment towards judgment. Paying off judgment does not mean that they get to stay. --146.165.xx.xx
