State Specific Question About: NEW YORK (NY)

I own a 4 family, hundred year old brownstone that was renovated in 2006. Part of the ceiling collapsed in one of the apartments and the insurance won't pay. They said it came from normal wear and tear. Does that sound right. The apartment is in excellent, well kept condition.

Not enough information. What does your policy say?

What do you expect the cost of repair to be? Unless the repair cost is more than a few thousand dollars, I would not contact the insurance company. --198.208.xxx.xx

I have a few hundred year old buildings with plaster ceilings ... some would have been dropping chunks unless repaired with plaster washers or drywalled over. Just a little water damage can considerably weaken the plaster.

Cleaning it up and throwing up a drywall ceiling is pretty cheap and certainly not worth an insurance claim. --128.252.xx.xxx

What kind of Wear and tear does a ceiling usually get ? I remember a popular song called "dancing on the Ceiling" I guess that might eventually cause it to fall in ??(LOL) I think I'd be getting a second opinion from an independent Adjuster. --99.151.xx.xxx

I had half the ceiling plaster in a bedroom come falling down. After my investigation I found a neighbor used my roof to paint his third story exterior walls via a poll and a roller. His weight cut through the pair-a-pit roofing material and it rained the next day. The rain soaked my plaster and it came crashing down and destoryed my tenants furnature. The neighbors insurance company denied my claim, said my roof was old anyways. My insurance said they would not pay because I had no "water coverage". The police wouldn't arrest my neighbor for trespass and roof damage. I had to repair the roof, ceiling, flooring and tenants items myself -- even though the damaged was caused by another.
