State Specific Question About: GEORGIA (GA)

I have the below in my lease, and a prospective tenant wants me to take it out (being protective of his children), is the below a Georgia State Law, in the lease, or is it jkust to protect me? Is there anything that documents that this is law?

USE: The property shall be occupied by Lessee and family, consisting of one (1) adults(Jane Doe, SS# 000-00-000), and two (2) children (Bob Doe, DOB __________: Carol Doe, DOB __________). Lessee agrees to use the property for residential purposes only. Property shall be used so as to comply with all federal, state, county, and municipal laws and ordinances and any applicable declaration of condominium, declaration of covenants, conditions, and restrictions; all rules and regulations adopted pursuant thereto; and any community association bylaws, and rules and regulations. No animals or pets shall be permitted upon the subject property. --139.76.xx.xx

I need each occupant listed in the event of emergency, fire dept wants this info also. This way you know who is supposed to be the renters and then you charge extra for the unauthorized guests once they stay beyond 15 days in 100. --65.43.xxx.x

I used to put social security numbers in my leases, but I stopped a few years ago. I do put date of birth. However, I haven't had any new tenants with children since then.

For the children, you might just say - children under the age of 18 and their names.

My neighborhood directory used to list the children of residents and the year of birth, but stopped doing it a few years ago as some parents were concerned. --64.12.xxx.xx

If SSNs are listed on application, and same names appear as occupants of the property on the lease, why would you need SSNs on the lease?

SSNs are personal information. While LL needs to have them, they do not need to be (and should not be) written into a document like the lease.

If they wanted to protect their kids they'd know that the info you are requesting would help identify them in case of disaster such as a fire. When people ask me why I want that Info I just tell them it's so The coroner can identify the bodies easier. I do get some strange looks. --99.38.xxx.xxx

Does he want to take out the whole paragraph or just SS#?

Personally if this was in my lease I would not take it out. What does it matter if it is the lease if you're maintaining a file with all their information that they have provided to you anyway.

I'm exactly like Echo -- SSNs on the app and spots for children's names and DOB. I don't put them in the lease -- I see no reason to.

Also, just to note it, listing the children by name in that clause likely doesn't matter anyhow. In most cases, if they have another child (or adopt one), they can bring them in without your permission -- and telling them that they are violating the lease because some new child is not listed will likely get you a discrimination lawsuit, IMO.

So, my lease states the names of everyone over 18 -- and says it is for them and their children. I don't list how many children they currently have -- or any children's names or DOB. Just in the app.

If it were me, I'd leave the clause -- but remove the SSNs and children's names/DOB. If they are fine with it written that way, then I'd be fine with taking them.
