State Specific Question About: NEW YORK (NY)
What is the procedure if an apartment is thought to be unsafe and uninhabitable because of some recent damage caused to the ceiling and the tenant has a signed lease with 10 months remaining. Does the landlord incur any expense if the tenant has to vacate? --74.73.xxx.xxx |

A lot depends on what the lease says about relocating during repairs, a cieling is a 1/2 day job and next day seal/prime/paint - however it is useless until the source of the leak is located and repaired, tape a tarp under this area and route to a bucket, use koolaid to help trace the leak from plumbing fixtures. --65.43.xxx.x |

What does your lease state about habitability?
Screw some plywood up there to stabilize the ceiling temporarily. Make sure not to nail, but screw and make sure to hit studs. Then nobody has to relocate. --98.111.xxx.xxx |

Generally unless an apartment becomes completely uninhabitable and cannot be repaired withing reasonable amount of time tenant cannot get out of the lease. --24.6.xxx.xxx |

It all depends. Most standard leases have a provision stating that the lease becomes void, should the building become uninhabitable and is uneconomic to repair.
This of course pertains to the lease, and the tenant may have a case against the landlord or another tenant who caused the building to be condemned due to negligence.
What exactly happened there? Roof leak, pipe leak, fire, someone going off on a tangent, taking his place to pieces? --74.65.xxx.xx |
