State Specific Question About: NEW HAMPSHIRE (NH)

My tenant's utilities are shut off. She has not been at the apartment for the past 3 weeks. As soon as I found out, I gave her 30 day notice at beginning of September. Her rent is paid for September so I have to wait out the 30 days. Does anyone have anything in their agreement regarding utilities and if they are shut off? Or had any problem of this type? We are lucky this is not the middle of winter ... --65.175.xxx.xx

Bet a LL can reel of a dozen definitions of bizarre behavior just by thinking about own experiences! I would have tried to negotiate getting a break and handed over a cleaned unit, not just shut off the utilities and disappear. It's wasteful not to have an okay place rented asap. --125.25.xx.x

My lease requires the utilities to be on for the entire lease and include the day the keys are handed over. I send a letter before move out that reiterates this and lists a charge for utilities being turn off. If you can talk to the tenant tell them to turn them back on or give you the keys early. How do you know they are not there? I would post a 24hr notice to inspect leaks and enter in due time to check things for damages, prepare for the repairs needed after move-out, if excess repairs serve notice now - why wait for security deposit time? damages need attention by tenant before some vagrant breaks in and creates a larger mess and the tenant gets to walk because of the police report. --65.43.xxx.x

I also would post the 24 hr. entry notice. My main concern would be that there is a refrigerator full off rotting food or an animal left behind.

I even think that you cold declare it an emergency and wave the 24 hr. notice. You can be concerned about smelling smoke or hearing water running and the need to check it out. --24.136.xxx.x

Since they paid for September, I don't have a right to just enter the premises. I am, however, able to give 24 hour notice to do maintenance work, etc. and it is, in fact, due for filter changes. I'm still not allowed to touch anything.... and I thought of rotting food, too,... YUK! I do have it that utilities need to be on; but, again, they paid their rent... so attorney says I still have to wait out 30 days... and abandonment can only be claimed if the tenant has not paid rent.. --65.175.xxx.xx
