State Specific Question About: GEORGIA (GA)
So my eviction turned into a "got the keys back" situation with all that was left in the unit being dirty clothes, fur and fleas... it was nasty. I cleaned and am showing, but am wondering what my success rate would be if I go after my X-tenant for rents owed. He owes me for 2 months (starting on 3 with Sept). Got keys but never any notice. He was MTM with 30 day notice. I have not had to do this, so hoping I'm not completely off my rocker thinking I might get some money back....
Can I file in small claims and try and get something? He IS gainfully employed and I know where.....

You need to send him the Settlement of his Security Deposit and if that does not cover the rent owed and damages, then you sue him in small claims court and get your money.

Next time file for eviction. An eviction is a judgment against the person. Lesson learned: take lots of pictures, clean, send SD Statement, re-rent and file suit for lost rent and damages. --76.30.xx.xxx |

Plenty of pics, cleaned, will send SD statement ASAP, listed but not rented yet...

I rarely pursue my ex-Ts in Small Claims. They are usually not paying because they can't. So, I'm not going to squeeze blood from a stone.

I help a niece with property in GA, this damage award is the second cause of your filing for unlawful detainer, if you use a eviction service you already paid for this second action, gather move-in/move-out photos and your reciepts to restore the unit, you have 28 days till second cause hearing and if you ignore this you have to refile in SCC and pay for this twice. --65.43.xxx.x |
