State Specific Question About: MARYLAND (MD)

My renter caused significant damage to my plumbing at a tune of $2000. Shouldn't she pay? She claims her guest did the damage, but her name is the only one on the lease. The way the lease is written it appears she does owe for the damage. She is also a non-paying renter, for which I want to rectify. Maryland evictions are hard to come by.

If her guest did the damage and she admits to it then she is responsible. She can sue her guest to recover however she is responsible for paying you. --24.6.xxx.xxx

Exaclty, what happened? The guests went into the basement and started to rip out the plumbing? Or did the main get clogged with the guests' do-do and required the old orangeberg line to be retrenched/replaced? Big difference.

Actually she is denying everything. The plumber found a small hand towel (How anyone flushes that down a toilet is puzzling). Apparently the towel was wrapped around a sewage ejector and caused it to burn out. It was a BRAND NEW TOILET installed by a certified plumber. Now she's saying that I must have caused the damage. --64.12.xxx.x

You stated that she was non-paying tenant, if that is the case why are you not evicting?

File in small claims court for damages to plumbing, it doesn't matter if her guest is an attorney... defendant cannot be represented by attorney in small claims court anyway. --24.6.xxx.xxx

Before you take anyone to court you need to understand what your chances to collect any real money is.

She is not paying her rent..

As for the plumbing problem, don't count on it being shut and dry, it could be a bad install, defective part. and the unit should have shut down if locked up, and to be hones $2000 is a little high for a stool job...

Small claims is like $30 to file, I would file and take my chances, the worst that could happen is that you will not win.

She hasn't paid Aug (at least) rent. Now there are plumbing issues. Its gotten ugly and she will get uglier with you. Just because she says she is not responsible doesn't make it true. File for eviction ASAP and stop all communication. Do not respond to email, text, phone unless she has all the money. I'd wait to file for damages because you don't know the full damages until she is gone. --76.30.xx.xxx

Thanks for all the replies. Just to reiterate, it was indeed the fault of the tenant or her guest. The plumber pulled from the ejector sewage a towel which wrapped around the pump. This caused it to burn out. I personnal accompanied the plumber and purchased the system. So with his labor (including cleaning out a sewer line) the cost was $2000. I have started the eviction process which could take months based on Maryland's slow system and backlog. I have further been informed that the plumbing is again ruined. I refuse to repair it until she is OUT. --64.12.xxx.x

Refusing to repair plumbing if it makes her toilet/drains unusable will be seen as a self-help eviction and, depending on your state laws, will at a minimum get you into some trouble and could cost you a great deal of money.

You need to follow the laws for eviction and then sue her in small claims if you can't do it all with the eviction. In the meantime, you need to keep her plumbing working -- revenge will NOT get you ahead in this business. And, to be clear, it is a business -- which you are taking too personally if you think that revenge is the answer.
