State Specific Question About: NEW YORK (NY)
My tenant moved out but did not leave a key, nor do I have a copy of the key to the apartment. What should I do? Do I have to wait a certain time period before calling locksmith?
Please help.

Were you aware they were moving? If so, did you tell them to leave the key somewhere and they did not. If so, I would replace the locks. You should always have a copy of the key as the owner of the property-make that no. 1 on your priority list. --192.249.xx.xxx |

Pony up the $75 bucks to have the locksmith come out. At $2 a piece, get additional copies of the keys.

This situation is more likely state specific and more information would be needed. For example, did they give you written notice they were leaving? Or is this a surprise move out?
At the top of this page is a link to LL/Tenant state laws. You should be able to find your answers there.
Me, personally if I felt the tenant was out I would enter thinking I might have a water leak and go from there. Once I got in, if it truly appeared they were gone I would change the locks and get it re-rented. But, I do risk some legal ramifications if I am wrong. Proceed with caution.

Picking locks is not so easy. If you have the right under your state laws and the facts of your situation, you should hire a locksmith, if you can't easily "break" in.
I can usually gain entry somehow. I try the windows first, then I try to pick the locks, then if I have to, I drill out the locks. I have an inverter so that I can run my electric drill from my truck's battery.
