Hi,
I'm wondering if I can legally serve my tenants a 5-day eviction letter. If so, do I take two copies of the letter (both signed and dated by me) and have the tenant sign and date both copies, leaving one with them?

It depends on your state law. Look at the top of this page under Landlord/tenant state law. Here you merely have to hand a copy to anyone over 12yrs old who answers the door, no signature required. If no one answers merely posting a copy on the front door is all that is required and the state considers it served. I've never heard of a 5 day eviction letter - sounds like a 5 day pay or quit; most of the time, that is the ONLY notice you can "serve" as LL.
Sounds like you are operating off of poor advice, or "what someone told me". Recommend that you either get under the covers with your state's LL/T law and get freaky with it so you know what you're doing/talking about, or consult an attorney or eviction service. --24.113.xx.xxx |
