State Specific Question About: MISSOURI (MO)

Ok i evicted a woman on Tuesday of this week now i have seen her boyfriend basically living there ever since I'm worried that I cant get the unit in now 7/ out of ten days days because of someone else living there, is my way of thinking right?? what should i do??? I would just wait the 7 days and have zero contact with them. If he is left over after the 7 days...he is tresspassing or squatting on the premises..have him arrested.

When you say evicted, do you actually mean that you got a judgment for possession? Or that you filed a motion for restitution? Or that there was a set-out with the sheriff's deputy?

The answer will depend on what you meant when you said eviction. Usually that means that there was a set-out - after which you can change locks. --205.188.xxx.xx

I have rent and possession judgment for her in the unit. So after the ten days and the sheriff visits i can change locks? what if water and electric is in there name can i still have it shut off? I though you couldn't do that? Thank You for all your help :) --99.102.xxx.xxx

The process can be very slow.

It appears all you have done so far is get the judgment. You need to file a motion for restitution. The judge won't even sign it until ten days has lapsed. Then it is served on the tenant. The tenant has a few days to get out. And if the tenant doesn't, you then set an appointment with the sheriff's office for a move out. Depending what county you are in and how busy they are, that may be anywhere from a few days to weeks.

So, you are far from being able to change locks. The time when you can change locks is when you meet the sheriff's deputy there with your helpers and a big supply of boxes and trash bags to physically put things out on the street.

Hopefully the tenant will move out before it comes ot that.

Some landlords give cash for keys - even if the tenant owes money. I never did that, but I did once give a tenant money to rent a u-haul and gave her many boxes and heavy-duty trash bags. That was a lot cheaper than paying persons to pack up things and move them out with the sheriff standing by complaining. --205.188.xxx.xx
