Well, made it the first 6 years of my landlord career without an eviction. (I only have a duplex) Mailed and posted the "Quit or Pay" today on a long term tenant, in 7 working days I can file eviction papers (Fulton Co). W00T! Tenant was Month to month.
Info:
-tenant has moved out; only minor furniture, clothes and trash, more TRASH and TONS OF F'N FLEAS ARE LEFT
-electric and water on (tenants accounts)
-unit secured
-nuked the fleas but once won't be enough
Can I:
-start cleaning (but leave ALL stuff there bagged up???)
-arrange stuff for quick curbside deposit on eviction day
Should I:
-eventually shut off his utility accounts? (heard LL's can eventually be charged???)
Will I:
-have a snowballs chance in Heck of getting money back?
-tenant hasn't coughed up keys (I asked)
-tenant was month to month so how much would courts allow me to try and get back usually?

If tenant has moved out, why are you filing for an eviction?

Evicting fleas is harder than tenants. Read up to make sure they're gone. Nothing like getting that call after someone has moved all there stuff in and trying to get rid of the critters. You'll kill the 1st wave through contact pesticide; then the eggs will steadily hatch over 2 or 3 or even 4 weeks. --98.183.xx.xx |

NE pa - am considering that... just wanted to get feedback and not have thing bite me back.
Haven't gotten keys, or letter, electric on etc makes me cautious. Tenant said he wanted to keep unit but hasn't paid, feel official eviction may be way to go to be on safe side. Flea infestation was so bad, no way he was living there however. --170.140.xxx.x |

Get over there ASAP and do all the cleaning you can while utilities are still in tenants name. If there are carpets there are cleaning solutions you can use that also kill fleas. --70.250.xxx.xxx |

REad the package of the bug bombs, but I used to use them twice as often as the package instructions recommended. Because who knows, maybe there will be a few who mature early.
If T did not give you notice of his surrendering unit back to you, you need to go through with the eviction -- you may not enter, you may not clean, you may not rehab the place. If T did give you notice, and left the keys in the unit for you, you can immediately take possession and get to work.

I wish we could bomb the tenants but do it for the fleas, chances are what is there is yours, be kind in telling them to give you the keys and you will save there credit report, once you have them get-er-done, haul it all out, switch locks and unload the bombs and again so you get the hatchlings. --76.241.xxx.xxx |

Check you state laws RE: abandonment. Our rental agreement states , " if tenant leaves premises unoccupied for 5 consecutive days while rent is due and unpaid without notifying landlord in writing, this shall be deemed an abandonment of premises and tenants hereby authorize landlord to take possession of premises and property , dispose of any tenants property and re-rent premises without recourse by tenants"
I've tested this clause about five times in our courts and it has prevailed so far. --70.250.xxx.xxx |

Normally, I'm against talking at all in an eviction situation. but here, help the guy and help yourself. Explain what an eviction will mean and how bothersome it will be for him.
What does he get out of keeping the keys and getting REPORTED to the credit bureaus?
Help him make the call to turn off utilities and hope the place won't get vandalized.
What do you get out of an eviction? In CA, it would cost hundreds and the sheriff won't come for free and not for weeks, if you are unlucky. --125.25.xxx.xxx |

What does an evictin cost in your area? Here it's real cheap, so I would follow thru with it just to cover my rear.
