State Specific Question About: CONNECTICUT (CT)

I recently rented my condo to a girl with 3 children. I couldnt sell so i decided to rent it. We have a month to month rental agreement.She has violated the rental agreement in several fashions. However i was willing to overlook them if she paid on time. It was agreed that the 1st months rent be paid up front which it was 1100$ and the security deposit(2000$) be paid in 2 installments on the next 2 months also paying rent on the 1st of each of those months. Well i havent gotten anything but the run around since the initial 1100 to enter. I bounced a bad check from her and got hit with fees. I have no security deposit from her. All my appliances are brand new,flooring and carpeting. I even went to job lot and bought new curtain for the shower and toilet paper for her. Now i have no clue where I stand? If she doesnt pay before 1 week late expires....I guess my ? is can i go over there and tell her she violated the contract and hasnt paid so she has to leave. How long should i give her? Also,since there is no security deposit if anything is damaged or missing can she be charged with criminal mischief and/or larceny? --76.24.xxx.xx

Welcome to being a Landlord. You can go over whenever you want and TELL her that she has to leave, but she likely won't -- and you can't force her out.

You need to start eviction NOW (assuming any grace period required by your state has passed). You may want to get a flat-rate eviction attorney to handle your first one.

Next time, no one moves in until they have paid the first month plus S/D in good-as-cash funds. Period.

Next time, do proper credit checks and screen your tenants better.

You will likely have trouble trying to get any criminal charges for damages unless she willfully destroys something.

Your best bet is to evict and get a money judgment -- then hope that, one day, she actually has something you can garnish. Does she have a job?

Give her a pay or quit notice. Take the bad check to your local DA's office and see if criminal charges can be files against her . Take to an ATTY about having her evicted and the sooner the better it'll just get worse. --70.250.xxx.xxx

Yes,she can be charged with larcent and criminal mischief as long as you have pictures of the property before she moved in. If she refuses to pay you can take her to court and they will garnish her income. If she is unemployed then you have to wait until she has an income but believe me they will make her pay by judgement.(she will also be responsible for your attorney fees so dont be afraid to spend!) --76.24.xxx.xx

Well, in CT, statutes allow for an automatic grace period, so you cannot charge a late fee or evict for late/nonpayment until the 11th if rent is due on the 1st. --64.252.xx.xxx

1. Send appropriate legal notice to pay or quit for bad check.

2. Hire an attorney to do eviction but be hands on so you can do it yourself next time.

3. File hot check charges

4. All move in funds must be by certified check. I don't accept cash, it helps keep everyone's story straight.

Yep, you got the offical "welcome to landlord" welcome that happenes to most newbies.

All of the above advice is good, except I was a little concerned with Mike's response. They will make her pay...umm...not if she goes without income for awhile, moves out of state, or has ungarnishable income (Social Security, disability, cash under the table). You should definitely get a good attorney, but odds are you won't see your money for awhile, if ever. I only collect on about 1 out of every three judgments I've had. Luckily, I've not had any evictions in the past 3 years. Just broke that record last week, but I did get the judgment and she works for the Sheriff's office (hah, irony!). But who knows, might luck out.
