State Specific Question About: TEXAS (TX)

Writing this for a friend we'll call Jane.

Jane's ex (John) recently moved to Texas where he signed a lease, then had heart attack and stroke, and is now in hospice care- not expected to survive. There will be no estate left after hospice takes what little Soc. Sec. there is for his care.

Jane went to Tx to visit John and tie up loose ends.

The apt. Mgr.says the only way John gets out of the lease is by dying and even THEN he has to give 30 days notice.

Jane is packing up furnishings so a charity can take the stuff away.

Anyone have advice for Jane? She's not on the lease, nor does she have any POA for John. She's trying to do the "right" thing. --76.199.xxx.xxx

What recourse does this manager think he has against John? I would guess that John is pretty much judgement-proof. And that John doesn't really care too much about his credit rating at this point.

I would tell Jane to clean out the place, just to be a nice person, and to heII with the manager.

I wouldn't even spend the time to see if TX has a law letting hospice patients out of their leases -- after all, what can this manager do against Jane (nothing) or John (mess up his credit a little)?

It's crucial to give notice and return the keys asap to mitigate damages. This is tough - but a terminal illness is terminating more than the lease. It's life - suing John would be pointless. Just tell Jane to make haste as the 1st is near. --180.180.xxx.xxx

Chris, I think you missed the point. Jane is trying to be cooperative and responsible, but the apt manager is an idiot. There is no need for Jane to feel under any pressure to mitigate damages -- John isn't going to be able to pay any damages, and if the manager wants to pursue his estate, fine, let him.

"Jane" is doing the right thing. Clean out the unit and return the keys.

The LL has no legal right or authority to negotiate with any one other than the tenant or the tenant's legally appointed guardian concerning the lease. The lease is not a one-way contract. The LL is supposed to uphold his obligations under the lease.

The LL may or may not be stupid. He may be very happy that "Jane" is doing what she is doing. --75.20.xxx.xx
