Tenant being in jail is irrelevant. It gives you NO RIGHTS whatsoever.
You still need to wait for the Tenant to fail to pay rent and then serve the Notice To Pay Rent Or Quit. Follow all of the normal eviction procedures.
How do you know Tenant is in jail? Do you REALLY KNOW, or is it just rumor? Are you legally charged with this knowledge? You might not want to KNOW this.
Tenant was arrested. But what about bail? Tenant might be out and back in apt in a matter of hours. Ignore the entire jail thing. Your only horse in the race is to collect the rent or evict for non-payment.
