Stairs are not meant as a gathering place to socialize. A place to smoke cigs? What are they doing with the buts? Throwing them on the ground littering your property?
The stairs are access paths to the private dwellings of your tenants homes. You should also have No trespassing private property signs at the entrance of your court yard and on or around the stairs. As well as no loitering signs. --66.214.xxx.xxx |

If you are thinking of loitering as a form of prohibited conduct, here's an interesting note .June,11,1999 Rockstar, "The Supreme Court ruled that a Chicago anti-loitering law is unconstitutional because it violated one’s first Amendment right to assemble peaceably. This ruling indicates that the Supreme Court may eventually rule that curfews, which also indirectly restrict public gatherings, are also unconstitutional.
Justice John Paul Stevens, a Chicago native, said, “in this instance, the city has enacted an ordinance that affords too much discretion to the police and too little notice to citizens who wish to use the public streets.” He wrote that the ordinance, which gave police authority to disperse and subsequently arrest known gang members and those associating with them, was a “violation of freedom of assembly.”
“It criminalized status, not conduct,” Stevens wrote. “It allows and even encourages arbitrary police enforcement.” It is “impermissibly vague on its face and an arbitrary restriction on personal liberties.”
So it maybe that you could find yourself in hot water if you attempt to infringe on peoples rights ??

It is posted a private property no trespassing. Gathering on a private properties staircase which is not a public gathering spot with seating. It is tool of the property to gain access to the tenants private dwellings. Adding in cig smoking and littering of ashes and cig buts on the private property. Add in loud talking with in 10 feet of tenants doors. It's not a attractive nuisance it's a obnoxious nuisance. Posting the proper signs is imperative for this to work effectively and legally.

I'm with you, I was just showing you what the "Big Court" said. I don't see why Police can't disperse Gangs from street corners . I am all for private property rights. Please don't think that I in any way agree with that supreme court ruling . --69.148.xxx.xxx |
