Send tenant demand for payment via certified mail if they do not make the check good along with whatever your NSF charge is , They are liable for 3x amount of check not to exceed $500 plus amt of check, attorney fees of not less than $100 and interest of 18% per yr, plus costs/ expenses of collection. --70.244.xx.xxx |

Check with your bank to see what steps you can take. At a minimum I would withhold the amount plus fees from their security deposit. If you decide they can stay I would accept cashier's checks or cash only from now on. --205.188.xxx.xx |

Post a cure notice if they do not answer with cash in 3 days proceed to small claims asking for eviction, once they get served they may change their mind and pay off the late fees and rent but you can not hold a letter over their head, only the court can do this. --76.241.xxx.xxx |

What county are you in? Locally here, you turn in your documentation to the prosecutor, and you pay nothing. They tack on $25 penalty charge (to issuer), and give them 15 days to pay. If they don't pay up, prosecutor will issue a warrant for thier arrest. In my county, the cops won't go out of thier way to track them down though. In the next county east of me, the cops WILL take extra efforts to track them down. --66.228.xxx.xxx |

There's a reason to be happy to be in Indiana in case you're feeling low. In Kansas it is NOT a criminal offense to give a bad check to your land lord. Land lords here have only a civil remedy. --70.244.xx.xxx |

Hate to say it unless it is an election year the pros will not do much, and the Judge doe snot always give triple damages, they are pretty free giving the bud attorney fees....but you do need to serve them...
