State Specific Question About: NEW JERSEY (NJ) Hello

The township of Belmar there C/O is for 3 years time period.

The tenant moved in several years ago.

I had the C/O.

Then I did not relise the C/O is only good for 3 years

I then filled out the paper work in Belmar town hall recently and paid the $125 C/O fee.

I tried to do a walk threw the apartment & fix whatever, for the C/O.

For the past two months the tenant has been

preoccupied with family affairs.

They are not complying with me.

My question is - What could the tenant possiable

do to me because the C/O expiried a few years ago?

My self I just want to get the C/O on the unit.

If the C/O is for occupancy the tenant must comply with local housing for any inspection - post a 24hr notice and proceed with inspector to get this in compliance. Anytime a tenant slows me down I remind them the moving boxes may be the next adventure for them, this usually gets attention and conform to the rules which are ignored more often than followed. --76.241.xxx.xxx

The tenant can't really do anything to you. However the township may fine you for not haveing the C/O. If the tenant is not cooperating then i would do as Virden said --67.98.xxx.xx

You have issues:

In NJ if you do not have a proper CO for the rental you may not accept rent in any manner or form; to wit, if you do accept rent without the CO and the tenant brings an action you will have to pay all the monies back, there is no room for discretion with the judge, kind of like a strict liability offense no co equals no legal right to collect rent ,

So that is what the tenant can do to you; and yes I have seen the judge award such on multiple times in Freehold county court house

Then you add in the fact when Belmar comes out to inspect they will know when you pulled the last CO plus they will see a tenant in your rental without a CO, the inspector may inform the tenant you where not legally allowed to collect rent without a CO in place , Yes inspectors do such --69.248.xx.xx

Well, I guess you just have to go get it. We had to get a CO every year until it was found to be unconstitutional because the town was discriminating against college students.

There was a lawsuit by the landlord association but they are still going to have a liscensing fee of $50 per unit. I guess I should go over there and see what they want from me now if anyone is smart enough to know. I sure don't want any fines. --76.99.xxx.xx
