State Specific Question About: NEW JERSEY (NJ)

The tenant vacated the apartment last week and left a mess behind, more than the month and 1/2 security (the 5 year old wall to wall rugs are completely destroyed by the pit dog she snuck in recently, 2 destroyed sinks, holes in walls, etc). I am grateful that it wasnt worse and that I have a trusted former tenant moving in August 1st. The question I have is when I am fully finished with the repairs and within 30 days I intend to write up an explanation of why she wont be getting any of her security deposit returned but I dont have a forwarding address and she wont answer my phone calls. Can I mail it to the apartment she just destroyed with a return receipt and either it will be forwarded to her or the letter will come back marked as undeliverable. Am I covered by this or is there something more I should do? Ive been landlording for 8 years and never encountered this problem before. mail the letter to the last known address ( your apt) on the front put "Postmaster: Do not forward , address correction requested" Also keep a copy of the letter. When/ if you get the returned letter keep it on file. If you do get the new forwarding address you can sent them a letter there and you'll also know where to serve them at. --208.189.xx.xxx

Do the accounting and make sure they owe you money.Do not use up exactly the amount they have on deposit.Send it return receipt requested to your property where they lived.If you get it back leave it in her tenant file unopened so the judge can open it himself if it comes to that --205.188.xxx.xx

In NJ you have to have all the bills for the money you spent and they have to be photocopied and mailed certified.

You can send it to the apartment that was just vacated and if the mailman can't forward it he will try three times to get a signature. After that, it will be returned to you and then you have evidence that you tried to send the explanation/receipts.

Make sure you pay for a Return Receipt. That is the little green card that goes on the back of the envelope with your address on it for the mailman.

You MUST have receipts for everything or risk paying double the security if this goes to court!!!! New law!!!!

Carpeting can only be prorated. You can't charge her for new carpeting even though she destroyed it.

Carpeting is only good for seven years according to tax rules which this state follows.

So if it's two years old then you can only get back 3/7 of the value.

Take photos of the ruined stuff before you throw it out so a judge can see the mess if you have to go to court. --76.99.xxx.xx

As usual you all came through with some great advice and I thank you. I just got back from working on the apartment. This is my honeymoon week and my new husbands introduction into landlording (he thinks I should sell it all...lol) I intend to add everything up before I do anything and I have been keeping the receipts. This is the only time that I let a property management company find a tenant (at the time my dad was dying and two other very stressful things were going on in my life so I made a bad decision). That was still no excuse to check them out myself and I learned my lesson the hard way. Thanks again for the responses, just what I needed. --67.82.xxx.xxx
